Your information and Restado

 

Privacy Policy:

This Privacy Policy (“Policy”) describes how Restado Technologies, Incorporated, (“Company” or “we” or “our” or “Restado”) treats information collected or provided in connection with an end user’s (“you” or “user”) use of the Restado Platform (the “Platform”) including but not limited to Restado’s mobile device software application, which allows you to, among other things, make referrals to participating restaurants (“Merchants”) and earn or receive credits to use at participating restaurants. 


NOTE:  The Company does not knowingly collect information from children under 13 and the Platform is only intended for use by adults over the age of 18.  If you are a parent and believe that your child under the age of 13 has used the Platform and provided personally identifiable information to us through the Platform, please contact us at deleteaccount@restadoapp.com or the mailing address below and we will work to delete that Restado account and any such personally identifiable information.

 

Effective Date; Changes.

This Policy applies to all information collected by or provided to us on and after the Effective Date.  When we make any material changes to this Policy, we will change the Effective Date above and will inform you by e-mail sent to the address associated with your Restado account.  If you have not provided an email address to Restado, we will give you notice of changes by publishing a revised Restado Privacy Policy in this Site - we will not separately notify you of these changes. We will treat your continued use of the Platform following such notice as your acceptance of the changes.  However, we will seek your affirmative consent prior to applying any material change to this Policy on how we use or disclose personally identifiable information or information we collected or received prior to the date of the change.

 

Third Parties.

We may offer through the Platform or send to registered users links to or offers from third parties.  This Policy does not apply to information that you may provide to or that may be collected by third parties.  We encourage you to request such third parties to provide you with their applicable privacy policies and other terms and conditions before  participating or making a purchase.

 

Collected Information.

Information You Submit.  When you create an account with the Platform, we collect the personally identifiable information you provide in the registration form.  This information may include your name, e-mail address, and other information, that may be requested by the Company as determined by the Company, from time to time.

   
Social  Networking Information.  In the future, at the discretion of the Company, the Platform may allow you to create an account on the Platform by logging in through certain social networking services like Facebook or Google (“Social Service(s)”). Integration with Social Services will allow us to offer a more personalized experience to you when you use the Platform. When you log into the Platform using your Social Service account (“Social Account”) or link a Social Account with the Platform, we will collect information necessary to enable the Platform to access that Social Service and your data contained within that Social Service.  As part of such integration, the Social Service will provide us with access to certain information that you have provided to the Social Service, and we will use, store and disclose such information in accordance with this Privacy Policy.  However, please remember that the manner in which Social Services use, store and disclose your information is governed by the terms and condition and privacy policies of the third party operators of such Social Services, and not the Company.


Information Collected When You Use the Platform.  When you use the Platform, we gather certain non personally identifiable information from you, and this information can be associated with the personally identifiable information that you provide.  This includes the user’s name, mobile device ID and transaction details at participating restaurants, including, but not limited to, date of visit at participating restaurants, restaurant check number, and amount of purchases at participating restaurants.  This also includes usage information, such as information on when, how often and for how long you use the Platform, which Merchant profiles you browse and server log data such as a browser type.  When you click on a Merchant recommendation link and are logged into the Platform, we may track the fact that you have clicked that link.


Location-Based Information: The Platform includes location-based features, built to allow us to suggest Merchants based on your location, to verify your patronage of Merchants, and to verify receipt images posted by Referred Users. We regularly collect your location information by using the GPS capabilities of your mobile phone, unless you choose to turn off our location services through your mobile device preferences.  By using the Platform, you consent to our collection, storage, and analysis of your location data.

 
Cookies. “Cookies” are small text files containing a string of alphanumeric characters that are downloaded by your web browser when you visit a web site.  The use of cookies is very common.  We may use both session cookies and persistent cookies when you access and use the Platform.  Cookies are used to remember your user account information, your preferences, and customize the interface of the Platform for you.  A session cookie disappears after you close your browser.  A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site.  Persistent cookies can be removed.  Please review your mobile web browser’s documentation to learn the best way to modify your cookie settings. 

 

Disclosure of Information

We internally use the information we maintain about you as follows:

We will use submitted information for the purposes for which you provided the information including, for example, to create and maintain a Restado account for you.

 
We use submitted information and collected information to provide the Platform to you, including to enable you to use the promotions and rewards you earn through the Platform.

 
We may use submitted information and collected information to personalize the content that you and others see based on personal characteristics or preferences.  This may include using information relating to your use of the Platform and your purchases with Merchants to provide you with Merchant recommendations and offers that may be of interest to you.

 
We may analyze collected information relating to your use of the Platform in order to help us improve the Platform and develop and improve other products and services.

 

 
We may use submitted information and collected information to help troubleshoot problems, provide you with required notices, enforce our User Agreement (for example, when necessary to protect our or a third party’s intellectual property or proprietary rights), or to alert you to changes in our policies or agreements that may affect your use of the Platform.

 

We use and disclose the information we maintain about you as follows:  

 
We may provide a Merchant with information user’s name and transaction details (such as date of visit, check number, and amount of purchases) specific to users who have shopped with that Merchant, in order to improve customer experience and verify transactions including referrals over the Platform.

 
We may also provide a Merchant with contact information for users who indicate that we may do so in order to receive recommendations and offers that may be of interest to them and to respond to comments from a User.

 
We may provide advertisers, Merchants and other third parties with aggregated, non-identifiable information about our user base and its interests, purchase patterns and usage patterns.

 
We may provide you with the ability to share information relating to your usage of the Platform on certain social networking services like Facebook or Twitter (“Social Service(s)”) or other websites or online services, in the future.  If you choose to engage in such sharing, please be aware that your submission of such information will be subject to the privacy policies and practices of the applicable Social Service, website or online service, and that we cannot control how third parties who access such information may use or disclose it. 

 
We may disclose non-personally identifiable information to third party partners in furtherance of our business arrangements with them, including without limitation to jointly offer a product or service to you or create interoperability between our products and services and the products and services of such partners.

 
We will use and disclose information where we, in good faith, believe that the law or legal process (such as a court order, search warrant or subpoena) requires us to do so or in other circumstances when necessary either to protect the rights or property of Company, our users, and third parties.

 

Viewing and Amending Information.  

You can log into your Restado account and view and change your user account information at any time.  We may also email you at the email address provided on your user account to confirm changes with your user account.

   

 

Choices Regarding Third Party Offers.

To the extent we send you commercial e-mails regarding third party marketing or promotional materials, we will give you the ability to opt-out of receiving such e-mails in accordance with applicable law.  We will not provide your personally identifiable information to third parties for their own marketing purposes without your consent.

 

Security.

The personally identifiable information we collect about you is stored in limited access servers.  We will maintain reasonable safeguards to protect the security of these servers and your personally identifiable information.  However, no security measures are 100% effective and we cannot guarantee the security of your personally identifiable information.

 

Transfer As Corporate Asset.

In the event of a merger, sale of capital stock or assets, reorganization, consolidation or similar transaction involving Company, the information we possess (including personally identifiable information) shall be transferred as a corporate asset to the acquiring entity, provided that such entity will continue to handle such information in accordance with this Policy. 

 

Transfer to the U.S. or other Countries.

Company is established in and uses facilities in the United States.  Your information will be stored and processed in the United States or other countries where Company has facilities.  By using the Platform, you consent to the transfer of information outside of your country, even if your country has more rigorous data protection standards than the United States.

 

California Privacy Rights.

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by Restado to third parties for the third parties’ direct marketing purposes during the immediately preceding calendar year.  To make such a request, please send an email to founders@restadoapp.com or write us:
